1- GENERAL DEFINITIONS
This website is operated by SFAKIANAKIS KONSTANTINOS, owner of an individual company of baby equipment rental that goes by the name BABIES GO LIGHT, BGL for shortcut, in this website. By visiting this site or renting something, you agree to be bound by the following terms and conditions.
In this agreement “You” are the Client and “We” are Babies Go Light.
2 – PRESENTATION OF THE ACTIVITY:
Babies Go Light rents baby equipment in Crete. The rental period is from 1 day to as long as You need.
The renting service is subject to material availability, and it refers to all the material that can be rented through our web. The photographs and texts on the site are not contractual, and there may be slight variations in colors that will not affect its quality or the renting agreement.
The order should be made through Babies Go Light’s rent system in our website or by email, phone, etc. Once you proceed to payment you will receive an email from us confirming your reservation. The order is considered validated once we receive your payment. This fact brings into existence a legally binding contract between us.
Payment can be done via PayPal or credit/debit card.
The rental period begins on the date on which we make available the equipment to you. The entire rental period will be charged regardless of the events that reduce the number of days of use of equipment, and even in case of early return. After the rental period the equipment must return. In case You want to extend the rental period it is possible upon contact with BGL and depends mainly from product availability.
4- DELIVERY OF THE EQUIPMENT
BGL delivers to all addresses in the city of Heraklion. We –or someone designated by us- will deliver at the address you indicated us in Babies Go Light’s renting system. We reserve the right not to deliver outside Heraklion area and to charge additional delivery costs if we do decide to deliver outside this area.
We will deliver in Heraklion area between 9am and 6pm from Monday to Friday and from 9am to 3pm at Saturday, at the address and time agreed on Babies Go Light’s rent system or email, phone etc. The time slot you requested in Babies Go Light form is not contractual and we reserve the right of changing in case necessary or case of force majeure. For deliveries outside our service times (9am-6pm) we reserve the right to charge extra costs.
Delivery and pick-up costs (VAT included):
· free of charge for any order to be delivered in Heraklion city between on working hours.
· 3 euros for BUS delivery or pick-up under BUS service schedules for one way ticket.
· 10 euros for deliveries or picks-up on Sundays, Bank Holidays, National Holidays and/or outside our delivery hour service.
· In case of delivery with transport companies usually the delivery fee will be at 6 euro one way ticket or it will be calculated before payment.
In case you –or someone you designated – are not at the address and time agreed, we will try to contact you by email or phone to set up a new delivery or pick-up appointment: in that case we reserve the right to deliver or pick-up late and to charge you for additional delivery cost. We also reserve the right to rent out to another client any equipment that could not be delivered on the date or time agreed. In the latter case the rented equipment will be charges and only the delivery costs will be returned.
In case of events out of our control and cases of force majeure (strikes, storms, delays in the return of previous rentals, etc) we may be obliged to delay or annulment delivery, in which case we cannot be held responsible for their direct or indirect consequences.
Material will be delivered clean and in good conditions, with proper packaging when needed. Rented items will be cleaned and disinfected after every pick up, either with baby and dermatology tested cleaners or alcohol wipres or steam cleaning. In the majority of cases from both cleaners and steam cleaning. You must check the material when received.
In case the material it is not in good condition or does not correspond with the equipment ordered, you should inform us immediately and we will replace it as soon as possible.
At the time of the pick-up you are obligated to read and sign the delivery form filled from us at this time.
5-USE OF THE EQUIPMENT
All equipment rented remain at all times the property of Babies Go Light. The rented equipment is for private use not for commercial use, unless prior agreement with Babies Go Light.
You have to carefully read the instructions that we will supply with the equipment prior to its use and to follow the instructions at all times while using the equipment.
You have to take care and ensure the safekeeping of the equipment.
You have to use the equipment in a safe and sensible manner and in accordance with both the purpose for which it was supplied and the manufacturer’s instructions.
As it is required during the course of any other activity, the supervision of an adult is mandatory while children are using any of the rented items.
The assembly of the provided items will be carried out by you.
The majority of our items are provided totally or partially assembled.
6- CONDITION OF EQUIPMENT ON RETURN
At the end of the rental period you must return the material in the same good condition in which you received it and only slight damages and wear due to the normal use should be accepted.
When returning the equipment rented, in case a product or part of it, is damaged, broken, lost or stolen, making it temporarily or permanently unusable for a new location, you will be charged with the market value of the product in question.
The equipment must be returned with the same, or similar, packaging system if it was initially provided. If the packaging system is damaged or destroyed, additional amounts may be charged.
All items must be returned clean, if the item is returned dirtier than expected for a proper use, additional amounts may be charged.
In case the equipment is returned to us late within 48 hours after the end of the rental period, with no further notice from you, we reserve the right to charge additional amounts. In case the material has not been returned to us 24hours after the end of the rental period, you will be charged with the market value of the product in question
We will report to you, within 3 working days after return of the rented equipment, any damage and / or malfunctions of the products, and we will inform you of the costs you will be charged of.
To cancel your contract with us you must notify us in writing, by email in the address email@example.com and write us information about the bank account you want us to return the amount charged.
In case you cancel your order or part of it:
- A week before the agreed pickup date there are no charges
- 5 days before the agreed pickup date you will be charges with the 25% minus delivery cost
- 48 hours before the agreed pickup date we will only return the delivery cost
The entire rental period will be charged regardless of the events that reduce the number of days of use of equipment, and even in case of early return.
Babies Go Light reserves the right of refusing the rental or cancelling the order in cases like: no stock availability, failure of order payment, delivery outside area, etc. Once you have been notified by us that we are cancelling your contract any sum you paid will be entirely return to your account within 5 working days of the cancellation of the contract between us.
8. BABIES GO LIGHT RESPONSIBILITY
If the equipment we deliver is not what you ordered or is damaged or defective we shall have no liability to you unless you notify us immediately when received. You must check the material when received. In case the material is not in good condition or does not correspond with the equipment ordered, you should inform us immediately and you can choose to receive a full refund or ask for replacement. In that case we will do our best to replace the equipment as soon as possible.
Babies Go Light is not responsible for any accident, damage, illness or injury which may occur due to the inappropriate use of the provided items.
We will not be liable to you for any indirect or consequential loss, damage or expenses and we shall have no liability to pay any money to you by anyway of compensation other than to refund to you the amount paid by you for the equipment in question.
The agreement between us shall be governed by and interpreted in accordance with Greek law and the Greek courts shall have jurisdiction to resolve any disputes between us.
Before we deliver every item to you the specific equipment has been cleaned and sanitized properly. After the pick-off every item is being washed where it is possible and cleaned with proper solutions and alcohol wipes at first stage. At second stage of cleansing we use steam cleaners for total protection.
At the delivery the package of every item has upon the sanitized label.
BGL has no responsibility for illness, disease, injury or accident, even a fatal one, that may occur during or after the rental period including the new COVID-19 disease caused by the SARS-COV-2 virus.
PERSONAL INFORMATION WE COLLECT
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”
We collect Device Information using the following technologies:
– “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.
– “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
– “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.
Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, passport or ID number, payment information (including credit card numbers or information of your bank account), email address, and phone number are being proccesed by third parties such as Paypal and Eurobank EFG. We call these types of data as “Order Information”.
HOW DO WE USE YOUR PERSONAL INFORMATION?
We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
Communicate with you;
Screen our orders for potential risk or fraud; and
When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).
SHARING YOUR PERSONAL INFORMATION
We share your Personal Information with third parties to help us use your Personal Information, as described above (for example our accountant). Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.
If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through email (firstname.lastname@example.org).
Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.
When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.
